Terms of Service

1. Acceptance of Terms

By creating an account or using the Dregs platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Dregs is a fraud detection and user scoring platform. The Service analyzes event data, device fingerprints, and user identity information submitted by our customers to produce scores and insights related to humanity, authenticity, uniqueness, and behavior of end users. The Service includes a tracking script, REST API, dashboard, and related tools.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, including API keys. You are responsible for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorized use of your account.

You must provide accurate and complete information when creating your account and keep this information up to date.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the rights of others, including privacy rights
• Submit data that you do not have the right to collect or process
• Attempt to gain unauthorized access to the Service or its infrastructure
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to discriminate against individuals in a manner prohibited by law

5. Data Processing

You are the data controller for any personal data you submit to the Service through your tracking script or API integrations. You are responsible for ensuring that you have a lawful basis for collecting and processing this data, including providing appropriate notice and obtaining any required consent from your end users.

Dregs processes data on your behalf as a data processor. We will only process your data as necessary to provide the Service and in accordance with your instructions.

6. Intellectual Property

The Service, including its software, algorithms, designs, and documentation, is owned by Dregs and protected by intellectual property laws. You retain ownership of any data you submit to the Service. We claim no ownership over your data.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

8. Free Trials and Subscriptions

Free trials provide temporary access to the Service with certain usage limits. When a trial expires, scoring and analysis features will be paused. If the subscription is not activated within the grace period specified in your plan, your account will be deactivated and your API credentials will be disabled.

Paid subscriptions are billed according to the plan selected. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

9. Termination

Either party may terminate the agreement at any time. You may terminate by deleting your account through the dashboard. We may terminate or suspend your account if you violate these Terms, if your subscription lapses, or if required by law.

Upon termination, your access to the Service will cease and your data will be retained for a reasonable period to allow for reactivation or export, after which it will be deleted.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. DREGS DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT SCORES OR ANALYSIS RESULTS WILL BE ACCURATE, OR THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS. FRAUD DETECTION SCORES ARE PROBABILISTIC INDICATORS AND SHOULD NOT BE THE SOLE BASIS FOR CONSEQUENTIAL DECISIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREGS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO DREGS IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
