By creating an account, accessing, or using the Dregs platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.
Dregs is a fraud detection and scoring platform. The Service analyzes event data, device fingerprints, and identity information submitted by customers to produce scores, alerts, reviews, and related insights concerning humanity, authenticity, uniqueness, and behavior of end users.
Scores, alerts, reviews, and other outputs are informational tools only. They are probabilistic in nature and may produce false positives, false negatives, incomplete results, or incorrect conclusions. You remain solely responsible for your products, user interactions, compliance decisions, and any action or inaction based on the Service. Optional AI-assisted features may rely on third-party model providers and may generate inaccurate or incomplete output.
You are responsible for maintaining the confidentiality of your account credentials, API keys, and other secrets. You are responsible for all activity that occurs under your account and for ensuring that only authorized users have access to the Service.
You must provide accurate and complete information when creating your account, keep that information up to date, and notify us promptly if you become aware of unauthorized access to your account or the Service.
You agree not to use the Service to:
You retain responsibility for the personal data, content, and other information you or your users submit to the Service ("Customer Data"). As between you and Dregs, you are responsible for determining whether and how to use the Service, for providing any required privacy notices, and for obtaining any required consents or permissions.
To the extent Dregs processes Customer Data that is subject to applicable data protection law on your behalf, Dregs acts as your processor or service provider and will process that Customer Data in accordance with our Data Processing Agreement, these Terms, and your documented instructions as reflected in your use and configuration of the Service.
If you enable or request optional integrations or AI-assisted review features, you instruct us to disclose relevant Customer Data to the applicable third-party providers as necessary to provide those features.
The Service, including its software, models, algorithms, designs, trademarks, and documentation, is owned by Dregs or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you.
You retain your rights in Customer Data. You grant Dregs and its sub-processors a non-exclusive, worldwide, limited right to host, copy, transmit, analyze, and otherwise process Customer Data solely as necessary to provide, secure, support, and maintain the Service in accordance with these Terms, the DPA, and applicable law, including to generate aggregated or de-identified usage statistics that do not identify you or any individual.
If you provide feedback or suggestions regarding the Service, you grant Dregs a perpetual, irrevocable, worldwide, royalty-free right to use that feedback without restriction or obligation.
We strive to maintain reliable operation of the Service, but we do not guarantee uninterrupted availability, error-free operation, or that every feature will remain available in its current form. We may modify, update, or discontinue features from time to time.
We may suspend or limit access to the Service immediately if we reasonably believe it is necessary to protect the Service or others, investigate suspected misuse, respond to a security issue, comply with law, or address non-payment. Where practicable, we will provide notice and an opportunity to address the issue before suspension.
Free trials provide temporary access to the Service with certain usage limits. When a trial expires, scoring and analysis features may be paused, limited, or disabled unless you activate a paid plan.
Paid subscriptions are billed according to the plan you select. Unless otherwise stated in writing, fees are non-refundable except as required by law, and taxes are your responsibility other than taxes based on Dregs' net income. You may cancel a subscription at any time, and cancellation takes effect at the end of the current billing period unless otherwise stated in your plan terms.
Either party may terminate these Terms at any time. You may stop using the Service and, where functionality is available, request account deletion through the dashboard. We may suspend or terminate your account if you violate these Terms, create risk or potential harm for the Service or others, fail to pay applicable fees, or if termination is required by law.
Upon termination, your right to access and use the Service ends. You remain responsible for removing any tracking scripts, API integrations, or other dependencies from your systems. We may retain limited information as described in our Privacy Policy and Data Processing Agreement, including for legal compliance, fraud prevention, dispute resolution, backup retention, and enforcement of our agreements.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREGS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, DREGS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY SCORE, ALERT, REVIEW, OR OTHER OUTPUT WILL BE ACCURATE, COMPLETE, OR SUFFICIENT FOR YOUR PARTICULAR USE CASE. THE SERVICE DOES NOT CONSTITUTE LEGAL, COMPLIANCE, OR PROFESSIONAL ADVICE.
You will defend, indemnify, and hold harmless Dregs, its affiliates, and their respective officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Customer Data; (b) your use of the Service in violation of these Terms or applicable law; (c) your products, services, or decisions made using the Service; or (d) your infringement or misappropriation of any third-party right.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREGS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREGS' AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE, THESE TERMS, OR THE DPA SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO DREGS FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes or limits liability to the extent such liability cannot be excluded or limited under applicable law.
We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the "Last updated" date. If you continue to use the Service after the updated Terms become effective, you agree to the revised Terms.
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. You may not assign these Terms without our prior written consent, except in connection with a permitted transfer of your business, while Dregs may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. The Data Processing Agreement controls over these Terms to the extent of any conflict relating specifically to the processing of personal data on your behalf.
If you have questions about these Terms, please contact us at support@dregs.com.
